Prohibited Activities

6.1. Any form of Misuse is prohibited.

6.2. In particular, the Partner is prohibited from attempting to obtain Commissions by procuring business transactions themselves or through a third person using the Ad Media, Tracking Links, Cookies and/or other technical aids provided to them in the context of participating in the Program Terms using one or several of the following methods:

6.2.1. Fraudulently pretending or faking business transactions, for example by entering third party data without authorization, or by providing false or non-existing data in the context of providing services under the Program Terms;

6.2.2. Using Ad Media that enables Tracking although it is not displayed at all, not visibly or not in the manner and/or size stipulated by Trade Republic;

6.2.3. Brand-Bidding unless Trade Republic gave explicit permission to bid on certain branded terms or branded keywords. The Partner must obtain the permission of Trade Republic beforehand in writing. The permission must include an exhaustive list of the branded terms or branded keywords which are exempted from the prohibited practice.

6.3. Any form of Misuse may lead to the immediate blocking of the Partners’ accounts by Trade Republic. In case of a blocked account, the Partner may raise an objection (e.g. via letter, fax, e-mail) within one month following the blockage of the account in order to provide a statement and evidence that the chosen form of advertising has been in accordance with these Partner Terms.

6.4. Trade Republic may issue a notice of termination if it can credibly demonstrate the breach of the Partner Terms and the Partner shall not be entitled to any remuneration for transactions that can credibly be considered a result of or being affected by the breach, unless the Partner can reasonably confute its breach.

6.5. For each case of intentional or negligent breach of the Partner Terms, the Partner shall be liable to pay Trade Republic liquidated damages in each case equal to the sum of the remuneration claim of the Partner for all transactions that can credibly be considered a result of or being affected by the breach, unless the Partner can reasonably confute its breach.
