5.6. General Prohibitions. The Affiliate will not, and will not allow any third party to do the following: a. b. c. d. e. f. g. h. i. use robots or other automated query tools, computer generated search requests; fraudulent use of search engine optimisation services to generate or conceal impressions, inquiries, clicks, or conversions that are fraudulent or invalid; use any automated means or form of scraping, or other data extraction methods to access, query, collect, or use TikTok intellectual property, including logo, key visuals, creative materials and other Confidential Information from the Platform or otherwise; apply Affiliate Links or advertise Advertising Materials through any of TikTok’s social media channels to hijack Traffic; incorporate any lottery or lucky draw in the Affiliate Links and/or Advertising Materials; post random and/or irrelevant content that does not promote TikTok in respect of the Program (including, but not limited to, fake promotions, entertainment news, and clickbait product reviews); dumping Affiliate Links without content (including certain Advertising Materials) or sending duplicate content to the same audience; providing social media channels of other affiliates without consent to meet registration criteria; or running clickbait and/or social media ads with the intention to improperly gain Traffic. 5.7. Traffic Accuracy and Traffic Fraud Prevention. The Affiliate shall ensure the Traffic is acquired and reported accurately free of any Traffic Fraud. In the event of any proven or suspected Traffic Fraud on the part of the Affiliate and without limiting the generality of Clause 6, the Affiliate will be deemed to be in material breach of this Agreement, and, as a consequence and without limitation to other remedies that TikTok may have at law or equity, TikTok has the right to immediately terminate this Agreement by written notice to the Affiliate and be released from all obligations to pay consideration thereunder. 6. Disqualified Actions 6.1. Disqualified Actions. Notwithstanding anything to the contrary in this Agreement, the Affiliate agrees and acknowledges that Actions may be disqualified whenever they occur in connection with a violation of this Agreement or any other terms, conditions, specifications, statements, and policies that TikTok may issue from time to time that apply to the Program. Further, the following Disqualified Actions that would otherwise be Actions are disqualified and excluded from the Program: a. b. c. d. any Action arising out of and/or in connection with Traffic Fraud; any Qualified Purchase made after termination of this Agreement; where a cancellation, return, or refund has been initiated in respect of any Qualified Purchases; or where TikTok has a reason to believe that a Qualified Purchase is a result of a fraudulent transaction, violation, abuse, or illegal activity.
